Welcome to Greenlapse. These Terms of Service ("Terms") govern your access to and use of the Greenlapse mobile application, website, and related services (collectively, the "Service"), operated by Desert Hollow Ventures LLC ("Greenlapse," "we," "us," or "our"), a Nevada limited liability corporation.

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

Summary: What This Means for You

This summary highlights the most important things to know. It's here to help you understand the Terms quickly, but it's not a substitute for the full legal text below, which governs your use of the Service.

Your photos and data belong to you. You own everything you upload. We use it to run the app for you — things like identifying plants and generating timelapses. We do not use your content to train AI models. See Section 5.

You can delete your data at any time. You can remove any individual photo, plant, or zone whenever you want. If you delete your account, we'll make every reasonable effort to permanently delete all of your information. See Section 13.

Our plant care advice may be AI-generated, and is not expert advice. The guidance, recommendations, and analysis in Greenlapse are produced by automated systems — not reviewed by a professional gardener or horticulturist. Use it as a helpful starting point, not a definitive answer. We're not liable for plant damage, property damage, or personal injury resulting from following our suggestions. See Section 7.

Ring linking is managed through Ring, not us. We integrate with Ring's platform, but you connect and disconnect your Ring account through Ring's own app or website. Greenlapse doesn't control Ring's availability or your account status there. See Section 6.

Greenlapse does not charge you directly. The app is free to use. Linking a Ring device — which unlocks automatic photo capture — requires a compatible Ring subscription managed entirely through Ring and Amazon. See Section 4.

The app may have bugs or go down. We're an early-stage product. We'll do our best to keep things running, but we can't guarantee 100% uptime or that every feature will always work. See Section 9.

Disputes are resolved by individual arbitration. If we can't sort out an issue informally, disputes go to binding arbitration — not class action lawsuits. See Section 15.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Greenlapse. You accept these Terms by creating a Greenlapse account, accessing or using any part of the Service, or continuing to use the Service after we post updated Terms. If you are using the Service on behalf of a business or other legal entity, you represent that you have authority to bind that entity to these Terms.

2. Eligibility and Account Responsibilities

2.1 Age Requirement

You must be at least 18 years of age to create an account or use the Service. By using the Service, you confirm that you meet this requirement. We do not knowingly collect information from anyone under 18.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us immediately at support@greenlapse.app if you suspect unauthorized access. Greenlapse is not liable for any loss or damage arising from your failure to keep your credentials secure.

2.3 Accurate Information

You agree to provide accurate and complete information when creating your account and to keep that information current.

3. Description of the Service

Greenlapse is a plant and yard monitoring application that connects to compatible home security cameras (such as Ring devices) to provide users with:

AI-generated plant identification and tracking
Photo history, timelapse documentation, and visual change detection
Plant care guidance, watering recommendations, and growth analysis
Sunlight analysis and weather-aware plant care context
Informational plant facts and horticultural content

The Service is designed to supplement your own observation and judgment. It is not a substitute for professional horticultural, agricultural, or landscaping advice.

3.1 Beta and Early Access Features

Greenlapse is an early-stage product. Certain features may be in beta or preview and are provided "as is." We may modify, limit, or discontinue any feature at any time without notice. Features available today are not guaranteed to remain available.

4. Subscription and Billing

4.1 Paid Features

Linking a Ring device to enable automatic photo capture requires a paid subscription. Greenlapse sets the pricing for this feature; subscription plans and pricing are described in the app and are subject to change.

4.2 Billing Through Ring

All billing and payment processing is handled by Ring and Amazon through their platform. Greenlapse does not collect or store your payment information. By subscribing, you agree to Ring's and Amazon's applicable billing terms.

4.3 Cancellation

Subscriptions are managed through Ring's platform. To cancel, use Ring's app or website. Greenlapse does not have the ability to process cancellations directly. Cancellation terms — including whether access continues through the end of a billing period — are governed by Ring's policies.

4.4 Availability

Purchasing a subscription does not guarantee that any specific feature will be available at all times. Subscription features are subject to the same availability disclaimers described in Section 9.

4.5 Price Changes

We may change subscription pricing at any time. We will provide at least 30 days' advance notice of any price increase, delivered by email or in-app notification. Your continued subscription after a price change takes effect constitutes acceptance of the new pricing.

5. User Content

5.1 What You Upload

The Service allows you to upload photos, name plants, and provide other content ("User Content"). You retain ownership of your User Content.

5.2 License Grant to Greenlapse

By uploading User Content to the Service, you grant Greenlapse a limited, non-exclusive, royalty-free license to store, process, display, and analyze that content for the purpose of providing the Service to you. This includes running your photos through AI models for plant identification, analysis, and timelapse generation.

5.3 Use for Service Improvement

We do not use your photos, plant data, or other User Content to train AI models. We may use voluntary feedback you submit — such as support messages or in-app feedback — to improve the Service.

5.4 Privacy of Your Content

Your User Content is private to you. Greenlapse does not share your photos, plant data, or other User Content with other users or with third parties, except as described in our Privacy Policy or as required by law.

5.5 Your Responsibilities

You represent that you own or have the necessary rights to all content you upload, and that your User Content does not violate any third-party rights or applicable law.

6. Ring and Third-Party Integrations

6.1 Ring Account Linking

The Service integrates with Ring's platform to access camera feeds for plant monitoring. Linking or unlinking your Ring account is managed through Ring's own application or website. Greenlapse does not store your Ring credentials and does not independently control the status of your Ring account connection.

6.2 Account Deletion and De-Linking

If you delete your Greenlapse account, your Ring integration will be disconnected. If you unlink your Ring account through Ring's platform, Greenlapse will no longer have access to your camera feeds, and certain features will become unavailable.

6.3 Third-Party Services

The Service relies on third-party platforms and infrastructure providers, including but not limited to Ring (camera integration), Google Firebase (data storage), Open-Meteo (weather), and Google Gemini (AI analysis). Greenlapse is not responsible for outages or policy changes by any third-party service, their data practices, or any loss of functionality resulting from changes to their APIs or terms. Your use of those services is governed by their own respective terms.

7. AI-Generated Content and No Professional Advice

7.1 Informational Purposes Only

All plant care guidance, watering recommendations, growth analysis, sunlight analysis, pest and disease observations, and other horticultural content provided by the Service is created by automated systems and may be AI-generated. This content is for informational and educational purposes only.

7.2 Not Professional Advice

The Service does not constitute professional horticultural, agricultural, landscaping, or any other expert advice. AI-generated content has not been reviewed or verified by a licensed professional, may be inaccurate or inapplicable to your specific plants or conditions, and should not be the sole basis for decisions about plant care or treatment. Always use your own judgment and, where appropriate, consult a qualified professional.

7.3 No Liability for Plant Damage or Personal Injury

GREENLAPSE IS NOT RESPONSIBLE FOR ANY DAMAGE TO PLANTS, PROPERTY, OR PERSONAL INJURY ARISING FROM YOUR RELIANCE ON AI-GENERATED CONTENT OR RECOMMENDATIONS PROVIDED THROUGH THE SERVICE. This includes, without limitation, plant death, crop loss, allergic reactions, or injuries sustained while performing care activities based on guidance from the Service.

8. Prohibited Uses

You agree not to use the Service to:

Violate any applicable law or regulation
Upload content unrelated to plants, yards, or garden monitoring, or otherwise use the Service for purposes it was not designed for
Abuse, manipulate, or attempt to exploit the AI systems or other features of the Service
Upload content that infringes intellectual property rights or contains malware
Reverse-engineer, decompile, or extract source code from the Service
Scrape or systematically collect data from the Service without authorization
Interfere with or disrupt the integrity or performance of the Service or its infrastructure
Impersonate another person or misrepresent your affiliation with any entity
Attempt to gain unauthorized access to any other user's account or data

Violations of this section may result in immediate account suspension or termination.

9. Service Availability and Disclaimers

9.1 No Uptime Guarantee

Greenlapse will make reasonable efforts to keep the Service available, but we do not guarantee uninterrupted or error-free access. The Service may be unavailable due to maintenance, outages, bugs, or circumstances beyond our control.

9.2 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GREENLAPSE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GREENLAPSE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

In no event will Greenlapse's aggregate liability to you for all claims exceed the greater of (a) the total fees collected by Ring or Amazon on Greenlapse's behalf in the 12 months preceding the claim, or (b) $50 USD.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential damages. In those jurisdictions, our liability will be limited to the maximum extent permitted by law.

11. Intellectual Property

11.1 Greenlapse IP

The Service — including its software, design, branding, AI models, and all content produced by Greenlapse (other than User Content) — is owned by or licensed to Greenlapse and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

11.2 Feedback

If you provide Greenlapse with feedback, suggestions, or ideas about the Service, you grant us an irrevocable, perpetual, royalty-free license to use that feedback for any purpose without obligation or compensation to you.

12. Account Termination

12.1 Termination by You

You may close your account at any time through the in-app account settings or by contacting support@greenlapse.app.

12.2 Termination by Greenlapse

We reserve the right to suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive activity, or if we are required to do so by law. We may also discontinue the Service entirely with reasonable advance notice.

12.3 Effect of Termination

Upon termination, your right to use the Service immediately ceases. Sections 7, 9, 10, 11, 13, and 14 survive termination.

13. Data Deletion

You may delete any specific content — including individual photos, plants, or zones — at any time through the app. If you delete your account, we will make every reasonable effort to permanently delete all of your personal data and User Content from our active systems. Some residual data may remain in encrypted backups for a limited period before being purged as part of our standard backup rotation.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through a prominent in-app notice at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service before the effective date.

15. Dispute Resolution and Governing Law

15.1 Informal Resolution First

Before initiating any formal proceeding, you agree to contact us at support@greenlapse.app and give us 30 days to resolve the issue informally. Most concerns can be addressed this way.

15.2 Binding Arbitration

If informal resolution fails, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration may take place remotely by video or telephone.

15.3 Class Action Waiver

YOU AND GREENLAPSE EACH WAIVE THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. ALL DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY.

15.4 Exceptions

Either party may seek injunctive or other equitable relief in court to prevent irreparable harm. Claims within small claims court jurisdiction may be filed there.

15.5 Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles.

16. General Provisions

Entire Agreement. These Terms and our Privacy Policy constitute the entire agreement between you and Greenlapse regarding the Service.

Severability. If any provision is found unenforceable, the remaining provisions continue in full force.

No Waiver. Our failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.

Assignment. You may not assign your rights under these Terms. Greenlapse may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.
